SEC Presses for Internal Whistleblower Protections

James Koukios, who formerly led the Department of Justice’s FCPA whistleblower hotline and is now a partner in the firm’s Securities Litigation, Enforcement & White-Collar Defense Practice Group, discussed the impact of the Dodd-Frank whistleblower program. Mr. Koukios noted that the program has led to higher quality submissions prepared by attorneys with a financial interest in the potential awards. Moreover, “One of the first questions clients now have to consider when deciding whether to bring an internal issue to the authorities is the increasing likelihood a whistleblower may come forward, in which case they may wish to bring that conversation forward.”
