Jessica Kaufman is head of Morrison Foerster’s New York litigation practice, with a focus on commercial litigation and complex class actions. Her commercial trial and arbitration practice includes representing clients on both sides of a wide variety of business disputes in arbitral fora and federal and state courts. She has two decades of experience with disputes and advisement in the payments space, from representing financial institutions and Fintech clients in consumer class actions and regulatory matters, to leading complex business disputes involving payment and payment network-related claims from pre-dispute resolution through trial. She has deep experience in class, mass arbitration, and mass tort actions spanning consumer, RICO, and data privacy matters. Recent representative matters include serving as lead counsel in a jury trial for a major shipping company defending against contract and UDAAP claims in connection with shipping charge disclosures, resulting in a complete victory; serving as lead trial counsel for a generic pharmaceutical company in litigation and arbitration arising from the termination of a significant distribution and marketing agreement, resulting in a complete victory in arbitration and favorable settlement of related business tort claims in federal court; the defense of a leading marketplace lender in a putative nationwide class action under state usury laws; and the defense of a financial advisory firm in related commercial disputes arising from a client engagement.
