Experience

(District of Delaware) Represented Postscript in an e-commerce marketing technology dispute against Attentive, which alleged patent infringement and copying. We secured summary judgment of noninfringement on all asserted patents, flipped the case through a counterclaim, and won a full infringement verdict with a nearly 20-year ongoing royalty, ending Attentive’s litigation campaign.

(Western District of Washington) Defended Epic Games against patent claims over interactive virtual concerts. Defeated three out of four patents pretrial and won a complete noninfringement verdict on the remaining patent. The jury also found an asserted claim patent-ineligible, a rare result under the clear and convincing evidence standard.

(ITC) Secured a complete defense victory for Insta360, a global leader in 360-degree camera technology in a dispute with GoPro. The Commission’s final determination cleared Insta360 of all asserted utility patent claims and brought the investigation to a final resolution in the company’s favor.

(Oregon Circuit Court, Washington County) Defended global logistics company in Oregon litigation over pricing practices. Secured over $1 million in breach of contract damages, won summary judgment narrowing counterclaims on federal preemption grounds, obtained a directed verdict on certain claims, and achieved a complete defense jury verdict after a four-day trial.

(District of Massachusetts) Won a $15.5 million civil jury verdict in Boston against the former mayor of Les Irois, Haiti, for extrajudicial killing, attempted extrajudicial killing, and torture.

(District of Delaware) Won a defense verdict of non-infringement in a patent lawsuit that sought nearly $85 million in damages involving technology connecting smartphones to a car’s infotainment system.

(Northern District of California) Won a jury trial in a trademark and copyright infringement lawsuit that both sides characterized as a referendum on marketplaces on the internet.

(Eastern District of Texas) Won a defense verdict for Activision in a jury trial involving allegations of copyright infringement.

(Southern District of New York) Represented Sprint and SoftBank before the DOJ/FCC and at trial against multiple state attorneys general seeking to block the T-Mobile-Sprint merger as anti-competitive. After a two-week trial, the court dismissed the case and the merger closed successfully.

(ITC) Represented Renesas in an ITC investigation initiated by Broadcom. Following an ITC trial, secured a victory before the Administrative Law Judge and the Commission on all four patents asserted against Renesas; victories were affirmed on appeal.
