Matt Mertens is a trial lawyer who represents clients in complex litigation in state and federal courts across the United States. His practice spans commercial disputes, product liability defense, public sector law, and matters at the intersection of technology, data privacy, and litigation strategy.

Matt regularly advises and litigates contract disputes, trade secret and business misappropriation claims, and matters involving nondisclosure and confidentiality agreements. He also has significant experience defending product liability claims nationwide for major retailers, handling cases ranging from personal injury actions to complex, multiparty wrongful death disputes. His product liability work frequently involves issues of corporate structure and liability allocation, including parent-subsidiary relationships, veil-piercing claims, and insurance recovery, and he routinely negotiates insurance subrogation claims arising from these matters.

In his public sector practice, Matt represents state and local governmental entities in tort and constitutional litigation, including matters arising under state tort laws and the First Amendment. He was selected as one of a small group of attorneys to represent the Biden-Harris campaign in managing the recount of nearly five million ballots in the 2020 U.S. presidential election in Georgia—the second-largest recount in American history.

Matt is deeply engaged in the use of advanced technology to enhance litigation outcomes. An accredited Certified Information Privacy Professional (CIPP), he regularly leverages generative AI and sophisticated electronic discovery techniques to develop efficient and effective case strategies. He frequently speaks on emerging issues at the intersection of data privacy, generative AI, and e-discovery.

Matt maintains an active pro bono practice, including representing incarcerated clients in constitutional challenges to criminal sentences and assisting individuals seeking asylum from political violence in their countries of origin.
