The Trademark Modernization Act (TMA) was enacted in December 2020 and brought about significant changes to federal trademark law. During this webinar, panelists will review the U.S. Patent and Trademark Office’s (USPTO) final rules that go into effect on December 18, 2021, and other key changes implemented by the TMA. These changes include new ex parte reexamination and expungement procedures for canceling trademark registrations that do not satisfy the use in commerce requirement, as well as the restoration of the presumption of irreparable harm for Lanham Act claims.
Our panelists will discuss important implications of these changes for brand owners, including:
- Providing a more efficient alternative to Trademark Trial and Appeal Board (TTAB) proceedings for canceling registrations that may be blocking your applications
- Reaffirming the need to document allegations that a mark has been used in commerce for all goods and/or services in your application
- Easing the burden on brand owners seeking preliminary injunctive relief
