Megan Gerking, a partner and member of the firm’s Antitrust and Competition Law practice group, will speak at the IBA Annual Conference 2025, taking place November 2 – 8 in Toronto, Canada.
Megan will join the panel discussion, “Cartels: to file or not to file for leniency,” on Thursday, November 6. The session will explore key strategic considerations for companies and counsel when deciding whether to disclose cartel conduct to regulators and file for leniency.
Panelists will discuss how the expansion of leniency programs worldwide and the rise of private damages actions in many jurisdictions are affecting the traditional cost-benefit analysis. The discussion will also address how regulators are uncovering cartels ex officio—through whistleblowing, active monitoring, and software tools—and how enforcement agencies are pushing the boundaries of what constitutes cartel conduct, including indirect information exchanges.
