This year’s agenda brings together timely topics shaping cartel enforcement and investigations on both sides of the Atlantic. From developments in whistleblower reward programs to a trial debrief on the first successful criminal labor antitrust case, and from bid-rigging to government procurement enforcement, the one-day conference is designed to offer practical takeaways and thoughtful debate on where enforcement is headed. Several panels will feature current DOJ enforcers.
Partner Lisa Phelan will once again serve as conference co-chair and will moderate the panel, “Trial de-brief: lessons from the first successful criminal labor antitrust case, US v Lopez (D.NV).” The panel will unpack why the government secured a conviction in Lopez following earlier trial losses in labor market cases. The discussion will examine how DOJ’s approach may have evolved, whether through the use of recordings, the presentation of victim impact, charging decisions (including the addition of fraud counts), or other strategic shifts, and what the case suggests about how juries evaluate wage-fixing theories compared to no-poach allegations.
