Theresa Foudy, partner and leader of Morrison Foerster’s Bankruptcy Litigation Group, will present at the Practicing Law Institute’s program titled “Bankruptcy & Reorganizations 2026: Current Developments.” She will speak on the panel “Liability Management and other Pre-Petition Transactions,” which will be held on Tuesday, April 7, 2026, from 10:15 a.m. – 11:15 a.m. ET. This session will cover key legal and strategic issues surrounding liability management exercises (LMEs), including the enforceability of pre-petition liability management transactions, litigation challenges that arise both before and after a bankruptcy filing, and the impact of LMEs on future restructurings and Chapter 11 plans. The discussion will also address the role of the Unsecured Creditors’ Committee (UCC) and other key stakeholders in LME-related claims litigation.
