Practicing Law with AI: Ethics, Privilege, and the Changing Practice of Law

Generative AI is rapidly changing how lawyers do substantive work and how law firms operate. AI’s growing use raises important questions about professional responsibility, confidentiality, privilege, supervision, and the role of judgment. This program examines both the opportunities and risks presented by AI in legal practice, from research, drafting, document analysis, and AI notetakers to emerging questions about attorney-client privilege and work-product protection.

Drawing on recent U.S. and European court decisions, ethics guidance, and real-world examples of AI misuse, the program will also explore the intersection of the power of AI and lawyers’ judgment, including what happens when lawyers’ reliance on AI leads to fabricated authorities, inaccurate court filings, confidentiality concerns, sanctions, and supervisory failures. The program will translate those developments into practical guidance for using AI responsibly, including understanding the capabilities and limitations of AI tools and their use in legal practice. The program will also look ahead to how AI may reshape legal practice, including the way lawyers deliver value, develop judgment, staff matters, and think about the billable hour, while emphasizing a principle that remains unchanged: lawyers remain responsible for the work they produce.
