Morrison Foerster partner Joe Folio, a member of the firm’s Antitrust & Competition Law practice, will speak on a CLE webinar, “FTC and DOJ Guidance on Ephemeral Messaging: Mitigating Regulatory Risks, Ensuring Compliance,” on September 17, 2026.
The webinar will address recent developments and practice tips related to guidance from the Federal Trade Commission (FTC) and the Department of Justice (DOJ) Antitrust Division on preserving electronically stored information (ESI) from corporate collaboration tools and ephemeral messaging platforms, settings that permit or automatically trigger the immediate and potentially irretrievable destruction of communications that may be responsive to agency investigative requests or discovery requests. The panel will highlight key issues for corporate counsel advising clients in this area and offer best practices for developing policies and procedures that strengthen governance while addressing organizations’ legal and regulatory risks.
