James Koukios published an article in Law360 that covered 2024’s three FCPA-related trials and the themes prosecutors deployed, noting the themes will likely continue in FCPA trials scheduled for this year and 2026.
James wrote that the themes “cut through the complexity of financial flows, intermediaries and foreign entities, and provided jurors with a reason to care about the defendants' alleged misconduct. When prosecutors can show that the accused corrupted power, acted out of greed, tried to hide it and did so in the jurors' own backyard, conviction becomes far more likely.”
