Liz Aloi, Carrie H. Cohen, Miriam Wugmeister, and Marian Waldmann Agarwal published an article in Law360 that discussed the increasing ubiquity of workplace surveillance tools and how general counsel and compliance leaders should assess how AI-generated data in the workplace is used to mitigate risk and possible legal exposure.
The authors wrote, "When deployed thoughtfully, AI monitoring systems can provide meaningful benefits by enhancing compliance, surfacing misconduct early and supporting consistent oversight across increasingly complex workforces. At the same time, because these systems increasingly inform investigative decisions and generate records that may be subject to discovery, the companies that are best positioned to manage risk will be those that approach surveillance tools with the same care and governance that they apply to other investigative and compliance functions."
