Bid Protest Spotlight: Solicitation Criteria, Missing Certifications, and Waivers

This month’s bid protest roundup highlights two decisions from the U.S. Government Accountability Office (GAO) and one decision from the U.S. Court of Federal Claims (COFC).

Veterans Management Services, Inc. illustrates the golden rule in government procurements: an agency must evaluate proposals the way it told offerors it would. Where a solicitation says recent experience “may be viewed more favorably” than older experience, an agency cannot instead treat older experience as though it does not exist.
