The Daily Journal has named securities litigation partner and co-chair of Morrison & Foerster’s Securities Litigation, Enforcement, and White Collar Defense Group Jordan Eth one of the Top 100 Lawyers in California. The publication compiles the list annually, highlighting lawyers’ successes from the past year.
Jordan is one of the leading securities litigators in the United States, known for his success in handling complex, high-stakes cases. He and his team have demonstrated the ability to win cases at every stage, most famously winning a jury verdict for JDS Uniphase Corp. and its former executives in a securities class action seeking $20 billion in damages—the largest securities class action in history.
In the last year, Jordan was one of the leads in the Pivotal Securities Software litigation, involving suits in both federal and state court. The MoFo team won dismissal of the federal suit. In state court, the team disputed the plaintiffs’ ability to engage in discovery before surviving a challenge to the complaint. The team took the issue to the United States Supreme Court, which granted review in July (a settlement is now under review and the Supreme Court hearing is being held in abeyance). “The Supreme Court takes maybe one securities case per term. . . they thought this was an important issue of statutory interpretation,” Jordan shared with Daily Journal.
The Daily Journal also highlights the successful defense of Precision Castparts Corp. in a section 10(b) class action where the Court granted MoFo’s second motion for reconsideration of its summary judgment motion and of Oracle Corp. and its directors in a derivative suit challenging the Company’s statements about its commitment to diversity.
