The Law Society of Hong Kong has honored Morrison & Foerster with the Bronze Law Firm Award as part of its 2021 Pro Bono and Community Work Recognition Programme, which recognizes law firms and individual lawyers in Hong Kong that have demonstrated outstanding commitment to volunteer pro bono and community work. Tim is a partner in Morrison Foerster’s Securities Litigation and Investigations + White Collar Defense groups. His practice focuses on government and internal investigations and complex commercial litigation and international arbitration matters. He is the former managing partner of the Hong Kong office.With more than 20 years of experience in the U.S. and Asia, Tim represents companies and individuals in complex dispute-related matters, including government and internal investigations, regulatory proceedings, securities class action lawsuits, international arbitrations, and other complex litigation mandates. He has represented multinational and Chinese clients in various industries, including telecommunications, biotechnology, publishing, pharmaceuticals, and financial services. Tim is a member of the firm’s FCPA + Global Anti-Corruption and Global Ethics + Compliance teams. Tim has practiced in New York, California, and Hong Kong, handling fraud, misrepresentation, breach of contract, securities litigation, investment disputes, commercial arbitration, and enforcement-related matters – from inception through trial. His practice has a strong U.S. and Asia nexus, and he regularly advises clients facing cross-border disputes and enforcement actions, often involving the laws of multiple jurisdictions.As a Hong Kong solicitor, Tim has been instructed by clients in key contentious proceedings and arbitration-related matters before Hong Kong courts (including the Court of First Instance, the Court of Appeal, and the Court of Final Appeal), as well in proceedings with Hong Kong regulators and statutory tribunals. Thomas Chou is the Managing Partner of Morrison Foerster’s Los Angeles office, where he advises on cross-border mergers and acquisitions, joint ventures, and private equity and venture capital financings, with a focus on the U.S. and Asia. With more than 25 years of experience, Thomas brings deep cross-border expertise, having practiced in MoFo’s Palo Alto, Shanghai, Hong Kong, and now Los Angeles offices. During his time in Asia, he served as head and co-head of the firm’s Asia Private Equity practice for 15 years.Thomas’ clients include industry-leading emerging growth companies and a broad range of investors who fund them (traditional private equity and venture capital funds, prominent Asian family offices, the corporate/strategic investment arms of large corporates, insurance companies, and sovereign wealth funds). Stephen Birkett is a Senior of Counsel at the firm and a Partner in our Hong Kong office.Stephen has practiced in Hong Kong for over 25 years and specializes in capital markets advisory and transactional matters, regulatory issues, and mergers and acquisitions transactions. His experience includes advising on the Hong Kong Stock Exchange Listing Rules, including numerous IPOs, and the Hong Kong Takeovers Code, as well as corporate and securities law and regulations generally. This includes advising clients on SFC licensing issues for intermediaries, non-contentious employment matters, and general commercial transactions.He recently advised a securities fintech business licensed by the SFC and which offers a Chinese language app for trading equities in select international markets on SFC compliance issues.Prior to joining Morrison & Foerster, Stephen served for three years as Senior Director of Corporate Finance with the Securities and Futures Commission in Hong Kong. Before that, he was a partner and Head of Corporate Finance in a leading international firm in Hong Kong. He was a member of the Hong Kong Government Standing Committee on Company Law Reform from 2011 until the end of his six-year tenure.Stephen is a frequent speaker at conferences on Hong Kong securities legal issues and has authored chapters on the Hong Kong Takeovers Code and Listing Rules in the popular “Practitioner’s Guide” series.Stephen is fluent in French and Spanish.
