NPC Standing Committee Enacts Law to Counter Telecoms and Online Fraud

On 2 September 2022, the NPC Standing Committee enacted the Law of the People's Republic of China on Countering Telecommunications and Online Fraud, with effect from 1 December 2022. The new law supplements existing laws and kickstarts a government-wide rectification campaign to combat telecommunications and online fraud.
In the October edition of GC Agenda China (subscription required), Morrison Foerster partner Paul McKenzie commented on the law that, “The new law gives PRC authorities far-reaching new powers to combat the thorny problem of online fraud, especially as the operations of fraudsters have increasingly gone cross-border. Among other things, the law will facilitate cooperation between PRC authorities with their counterparts overseas. It will also significantly raise the burden on telcos and many internet businesses to vet their customers and monitor their use of the online service.”
