Joe Palmore was featured in Communications Daily’s coverage of the Federal Communications Bar Association Judicial Committee’s webinar on the Supreme Court decision in West Virginia v. EPA, which suggests the major questions doctrine will likely play an increasingly important role in future decisions on actions by federal agencies.
“I think everyone agrees that [the major questions doctrine] reached next-level prominence over the last two years,” Joe said. “We saw the Supreme Court invalidate several major regulatory initiatives based upon the major questions doctrine in a short period of time” and cite the doctrine explicitly for the first time in EPA, he added.
