CFIUS expert and Morrison Foerster of counsel James Brower has been named in Global Competition Review’s inaugural Foreign Investment Control 40 under 40 list. The list aims to identify the next generation of the world’s top foreign investment lawyers through surveying law firms, economic consultancies, government agencies, academic institutions, and companies.
James is of counsel in Morrison Foerster’s Washington, D.C. office. He has unparalleled experience helping clients navigate regulations and restrictions related to foreign investment in the United States, including matters before the Committee on Foreign Investment in the United States (CFIUS) and related to foreign investment in the U.S. defense industrial base.
Prior to joining Morrison Foerster, James worked across multiple federal agencies involved in the CFIUS process, including the Office of Investment Security in the Department of the Treasury and the Defense Security Service, now the Defense Counterintelligence and Security Agency. While he was with the Treasury Department, James led CFIUS’s mitigation monitoring efforts and the deployment and implementation of the CFIUS Pilot Program—which evolved into the CFIUS declaration (i.e., short-form filing) process. He also led the review, assessment, and investigation of over 100 transactions and spent years handling complex CFIUS filings, transactions, and policies.
Since leaving the government, James has advised hundreds of clients on CFIUS-related matters, helped clients navigate the CFIUS assessment, review, and investigation processes, counseled clients on the Defense Counterintelligence and Security Agency’s facility security clearance and foreign ownership, control, or influence (FOCI) mitigation processes, and negotiated numerous agreements to mitigate national security concerns identified by CFIUS (i.e., CFIUS mitigation agreements).
