James Koukios spoke with Anti-Corruption Report about the resolution Albemarle Corporation made with the U.S. Department of Justice and U.S. Securities and Exchange Commission to resolve Foreign Corrupt Practices Act offenses.
“Companies will often use internal data to compare commission rates for similar services across jurisdictions or retain outside analysts to help them determine fair market rates within a jurisdiction,” said James. “And, of course, there should be an internal assessment of whether the commission rate is commensurate with the specific work to be performed by a third party or the economic risk that the third party itself is undertaking.”
