Notable work from our D.C. antitrust team included helping Unity Technology navigate an antitrust review of its US$4.4 billion purchase of ironSource after receiving a “close-at-your-own risk” letter from the Federal Trade Commission. Additionally, the team represented satellite communications company OneWeb in its merger with rival Eutelsat. The team also represents Avadel Pharmaceuticals in a case against Jazz Pharmaceuticals (“Jazz”) relating to allegations that Jazz abused the listing system in the U.S. Food and Drug Administration’s “Orange Book” to thwart competition for a narcolepsy treatment. Our global cartel investigations and litigation team also represents Jean-Paul Van Avermaet, a former chief executive of a private security services company that the U.S. Department of Justice has indicted on price-fixing and bid-rigging charges, in a rare international criminal cartel case.
MoFo’s Tokyo-based antitrust team is one of the largest of its kind among international firms in Japan, advising clients on a wide range of matters, including merger reviews as well as cartel, monopolization, unfair trade practices, and administrative fine (kachokin) cases. The team regularly works with leading Japanese and non-Japanese clients across a range of industries and has recently been particularly active in the technology, automotive, transportation, pharmaceutical, logistics, and consumer products/services sectors.
Notable work from our Tokyo antitrust team included advising Expedia on the Japan Fair Trade Commission’s high-profile investigation into major online travel agencies. Additionally, the team helped defend Fujitsu Semiconductor against claims brought in California by Cypress Semiconductor, which alleged that the company violated the state’s Unfair Competition Law by unfairly terminating a distributor agreement.
