California agrees to target the most struggling students to settle learning-loss lawsuit

Michael Jacobs was featured in an EdSource article covering the settlement in favor of the plaintiffs in the case of Cayla J. v. State of California, in which over a dozen plaintiff students filed a lawsuit against the state of California claiming they were denied educational equality guaranteed by the state during remote learning amid the COVID-19 pandemic.
The Oakland REACH, a local nonprofit that the named plaintiff’s family turned to when the district didn’t provide adequate services, signed on as a plaintiff in the lawsuit. This resulted in a provision in the settlement calling for amending the education code to encourage districts to contract or partner with community-based organizations “with a track record of success” for services covered by the block grant.
Michael called the provision an important and landmark element of the agreement.
“We saw during the pandemic that community-based organizations filled critical needs,” he said. “Now the evidence is in that the services made a significant difference in educational achievement.”
