Mary Kaiser spoke to Law.com about the Federal Trade Commission invoking the Robinson-Patman Act (RPA) of 1936, a law originally meant to protect mom-and-pop stores from price discrimination in the Depression, as it investigates drug pricing.
“The FTC’s invocation of the Robinson-Patman Act in its solicitation regarding the pharma industry is not surprising,” said Mary. “I expect to see RPA investigations and/or enforcement actions in other industries in 2024.”
