James Koukios spoke to Bloomberg Law about potential lessons to be learned about the future of Foreign Corrupt Practices Act (FCPA) enforcement from DOJ’s decisions to proceed, or not to proceed, in several FCPA trials following President Donald Trump’s Feb. 10 executive order pausing FCPA enforcement. James shared that the case that was dropped—which involved alleged bribes to obtain a planning permit to build a corporate campus in India—was more on the “operational side,” while the other three cases were closer to the FCPA’s primary concern, quid pro quo bribes to win or retain business. James also opined that the dropped case was “really hard” from an evidentiary and logistical viewpoint and perhaps not worth the resources being put into it.
