Hansa in its lawsuit before the Regional Court of Rostock against Splendid Drinks AG (“Splendid”), the trademark owner of the energy drink 28BLACK and sponsor of the club.F.C. Hansa’s lawsuit includes compensation claims for the 2024/2025 season as well as claims for damages and information under German civil law. Prior to the expiration of the contractually agreed upon minimum term, and without any notice, Splendid declared an extraordinary termination of the sponsorship agreement.“Sports and contract law are among our core areas of expertise,” explains Jakob Schellmann, counsel at MoFo. “We are therefore well aware of the club’s importance in the region and throughout the country. Jakob conducts litigation and arbitration in both German and English. Together with the Litigation Department, Jakob regularly explores new legal fields with a private law component. Such interdisciplinary matters include, for example, tax liability issues in connection with so-called cum-ex transactions, sanctions as obstacles to performance in supply contracts, and the valuation of licenses when challenging license fees. Jakob also regularly advises on product liability cases within supply chains, on disputes in the aircraft and railway industries, and on cross-border disputes in international business transactions. Jakob not only is active in the more common jurisdictions, but has also enforced claims in Kenya, Tanzania, Estonia, Bulgaria, Libya, and the United Arab Emirates, for example. Jakob also has extensive experience pleading in summary proceedings before the German courts.Jakob is active in training junior lawyers within the firm. He regularly gives classes on the subject of legal writing, taking strategic aspects into account.Jakob studied law at the University of Potsdam, Germany. He further received a master’s degree in International Law, with a focus on Alternative Dispute Resolution from Loyola University Chicago School of Law, USA. Jakob Schellmann führt Zivilprozesse und Schiedsverfahren, sowohl auf Deutsch als auch auf Englisch. Spezialisiert ist Jakob Schellmann dabei auf komplexe und großvolumige Streitigkeiten im Wirtschaftsrecht.Gemeinsam mit der Praxisgruppe Litigation erschließt Jakob Schellmann regelmäßig neue juristische Felder mit zivilrechtlichem Einschlag. Zu solchen interdisziplinären Mandaten zählen beispielsweise steuerrechtliche Haftungsfragen im Zusammenhang mit sog. Cum-Ex-Geschäften, Sanktionen als Leistungshindernisse in Lieferverträgen oder die Bewertung vertraglicher Lizenzgegenstände bei der Rückforderung von Lizenzgebühren. Regelmäßig berät Jakob Schellmann auch zu Produkthaftungsfällen in Lieferketten, zu Auseinandersetzungen in der Flugzeug- und Eisenbahnindustrie sowie zu grenzüberschreitenden Streitigkeiten im internationalen Geschäftsverkehr.
