Morrison Foerster (“MoFo”) represents Condor Flugdienst GmbH (“Condor”), Germany’s second largest airline, in its appeal of the European Commission’s merger control approval of Deutsche Lufthansa AG’s (“Lufthansa”) acquisition of joint control over Italia Trasporto Aereo S.p.A. “ITA”), the largest Italian carrier successor of Alitalia. The dispute is pending before the European Union’s General Court and relates to a conditioned merger control clearance granted after a so called phase II investigation by the European Commission.
