James Brower spoke to Foreign Investment Watch about the latest CFIUS Report to Congress and how it shows a decreasing caseload domestically despite increases across the globe. James noted that the relative maturity of the CFIUS process — when compared to the UK and French foreign investment regimes — may be impacting the number of filings.
James stated, "CFIUS, in some form, has been in existence for over 50 years. As a result, many transaction parties in the United States may have a more refined sense of the potential CFIUS risks of a transaction and when a voluntary filing is warranted."
