Lisa Phelan spoke to Global Competition Review about the Department of Justice’s (DOJ) investigation into healthcare technology company Claritev and its possible civil violations of U.S. antitrust law. Lisa said that early in an investigation, many companies and executives are not ‘targets’ even if they may be central to the case. As the probe continues and the DOJ collects evidence and testimony, the Antitrust Division then informs companies if they are the ‘targets’ of the probe.
Lisa stated, "Even though DOJ may be heavily focusing on a particular company, that company can still say they are not a target, unless and until DOJ expressly tells them that it considers the company a target and is preparing to indict it."
