Brian P. Sylvester is a partner in our FDA & Healthcare Regulatory and Compliance Group. He is the head of Food Regulatory and an influential thought leader and practitioner in the field of food regulation.Brian counsels clients across the full life cycle of regulated products, serving global brands, startups, life sciences companies, investors, and trade associations. He has been recognized by a number of legal industry awards and publications such as Chambers USA, Bloomberg Law, and The National Law Journal. Chambers USA reports that Brian “is widely noted as an expert in regulatory issues relating to novel food technologies, with significant experience advising on USDA and FDA regulations.”Brian focuses his practice on Food and Drug Administration (FDA) and U.S. Department of Agriculture (USDA) regulated products, with an emphasis on the food and beverage sector. He additionally counsels early-stage, growth, and global clients on all aspects of cosmetics, over the counter (OTC) drugs, medical devices, consumer products, and a range of Animal and Plant Health Inspection Service (APHIS) regulated commodities. Across all these regulated product categories, his work spans enforcement actions, audits and investigations, regulatory compliance, labeling and advertising, import and export, due diligence, consumer litigation, comment preparation, public policy advocacy at the federal and state levels, and new product development.In the area of food and beverage, Brian develops regulatory strategies to commercialize a range of food tech innovations, including transgenic crops and alternative proteins, such as cultivated meat and fermentation-derived food ingredients, among others. Claudia is renowned for her experience in advising clients on advertising and marketing compliance, including managing pre-litigation risk regarding advertising claims. She represents clients in consumer class action cases and complex litigation, including unfair business competition, false advertising, and product liability. She regularly handles matters before the National Advertising Division (NAD) and competitive advertising disputes. Claudia represents clients across a broad range of industries, from food and beverage to technology.Claudia is a leading partner in MoFo’s Food & Agriculture group. Ranked Band 1 in Chambers Agribusiness, this cross-disciplinary group has helped shape the industry for more than two decades. From disruptive new food startups to Fortune 50 companies, Claudia provides food and agriculture clients with holistic, innovative strategies that addresses their most pressing legal challenges and mission critical transactions.Claudia is also a longtime leader in MoFo’s pro bono program. She has represented asylum seekers and others in immigration proceedings, including traveling to El Paso, Texas, to work with families separated and detained at the border. She has also worked on matters relating to reproductive rights, gun violence prevention, and criminal justice reform.Claudia previously served as a Lawyer Representative for the Northern District of California and is a board member of the Bar Association of San Francisco, Diversity and Justice Committee, San Francisco Law Library, and Bay Area Legal Aid. Lena is an associate in the Litigation Department in Morrison Foerster’s San Francisco office.Lena’s practice focuses on commercial and class actions litigation, with an emphasis on false advertising, unfair competition, and antitrust. Lena regularly counsels clients in the food and beverage, dietary supplement, cosmetics, retail, and technology sectors. She advises clients on all stages of litigation, from pre-litigation and investigation through discovery, dispositive motions, and trial.Lena was previously a summer associate at Morrison Foerster and received her J.D. cum laude from University of Michigan Law School, where she served as a student attorney in the Michigan Innocence Clinic and an editor of the Michigan Law Review.Lena is fluent in Russian.
