Brandon Van Grack and Haydn Forrest authored an article for Just Security discussing what’s in store for the Foreign Agents Registration Act (FARA) in 2022, with major regulatory and statutory changes and enforcement actions on the horizon.
“One of the most significant actions that will impact FARA in 2022 is DOJ’s effort to amend and update the statute’s implementing regulations,” the authors wrote. “Last month, in an Advanced Notice of Proposed Rulemaking (ANPRM), DOJ [U.S. Department of Justice] floated a series of open-ended questions on ways to clarify and modernize FARA’s regulations, and invited suggestions from the public. The ANPRM’s public comment period does not close until February 11, 2022, after which DOJ will publish a Notice of Proposed Rulemaking that contains its proposed amendments to the regulations. Only after yet another public comment period will DOJ be able to publish new, final regulations.”
