Alex van der Wolk, Marijn Storm and Laura Stewart have authored an article, “Navigating Binding Corporate Rules: Updated Requirements in the EU and UK,” which was recently published in Global Data Review. The article considers different approaches to the European Union and UK’s binding corporate rules.
“Binding corporate rules (BCRs) are generally seen as the gold standard of compliance for data transfers from the European Union (EU) and the UK. Since Brexit, companies have had to navigate diverging regulatory frameworks and independent procedures to have their BCRs approved on both sides of the Channel. The different approaches were codified this year. First, the UK Information Commissioner’s Office separated its BCR from the EU by releasing its own BCR requirements in July 2022. Second, the European Data Protection Board released its draft on new BCR requirements for EU BCRs for public consultation on 17 November.”
