Two Distinguished Former Federal Prosecutors, Katherine Driscoll and Nathan Reilly, Join Morrison & Foerster
NEW YORK (September 13, 2021) – Morrison & Foerster, a leading global law firm, is pleased to announce that Katherine (Kate) Driscoll and Nathan Reilly have joined the firm as counsel in its Investigations + White Collar Defense Group, based in the New York office. Ms. Driscoll and Mr. Reilly join from the United States Attorney’s Offices for the Eastern District of Pennsylvania and the Eastern District of New York, respectively.
Ms. Driscoll and Mr. Reilly’s arrival follows the addition of dozens of top former U.S. law enforcement and regulatory agency officials to the firm in recent years including most recently Brian K. Kidd and Brandon Van Grack. These additions underscore the momentum of Morrison & Foerster’s expanding multijurisdictional investigations and white-collar defense practice in response to increasing client demand across the firm’s global offices.
“The addition of Kate and Nathan will enhance our ability to serve our clients operating in the healthcare, life sciences, financial services, and technology industries in particular, as these sectors will continue to be a focus of major government investigations in the coming years,” said Chuck Duross, global co-chair of Morrison & Foerster’s Investigations + White Collar Defense Group. “Their experience, insights, and trial skills will expand our capabilities and will be invaluable to our clients facing parallel federal and state investigations.”
Ms. Driscoll joins Morrison & Foerster from the Eastern District of Pennsylvania, where she served as assistant U.S. attorney in the Criminal Division. In this role, she prosecuted a wide array of white-collar crime matters in the healthcare industry, including COVID-19-related government fraud investigations and theft of pharma-related trade secrets as well as complex white-collar fraud and money laundering cases. Ms. Driscoll also has significant trial experience and worked with a wide variety of federal, state, and local law enforcement agencies in complex criminal matters. She received the 2019 Inspector General’s Award for Excellence in Fighting Fraud, Waste, and Abuse.
“I was attracted to the momentum of the firm’s white-collar investigations and criminal defense practice, the broad array of sophisticated clients and challenging matters, and the quality and character of the firm’s diverse team,” said Ms. Driscoll. “I am looking forward to helping our clients, corporate and individual executives alike, understand government compliance expectations and respond to government investigations.”
Also joining the firm is Nathan Reilly, a former federal and state prosecutor who held several high-level positions at the U.S. Attorney’s Office for the Eastern District of New York. Most recently, he served as senior litigation counsel, where he led a wide variety of criminal investigations and prosecutions, including in the areas of public corruption, investment fraud, commercial bribery, corruption, cybercrime, and tax fraud. He also worked on a number of high-profile investigations and prosecutions involving violations of the Foreign Corrupt Practices Act, the Foreign Agent Registration Act, the Bank Secrecy Act, and anti-money laundering statutes. Mr. Reilly also served as Chief of the Public Integrity Section and tried numerous cases to verdict as an Assistant U.S. Attorney. He has significant state government experience as well having served as an Assistant Attorney General in the Office of the New York State Attorney General in the Special Investigations Unit and as a Special Assistant to the Secretary of the Governor within the Office of the New York State Governor.
“Nathan’s breadth of experience as both a federal and state prosecutor, and his deep knowledge of anti-corruption, bribery, FCPA, and FARA, build upon our ability to assist clients facing multidimensional and cross-office investigations as well as the expansion of investigations by state Attorneys General and other local and state law enforcement and regulatory agencies,” added Carrie H. Cohen, a former federal and state prosecutor and lead of Morrison & Foerster’s State and Local Government Enforcement Group.
“In light of the increased coordination between federal and state prosecutors and the uptick in enforcement action by state regulators and prosecutors, I am excited to bring a unique view of investigations to our clients,” said Mr. Reilly. “I look forward to working with my new MoFo colleagues, some of whom I previously worked alongside, to help the firm’s clients navigate these complex matters.”
