Julie O’Neill spoke with Legaltech News about California’s amended automatic renewal law, which requires companies to provide renewal and cancel opportunity notifications to consumers.
“I don’t think these new California obligations are super onerous in the sense that it may not be too difficult to put in a system for reminder notices for California residents,” Julie said. “California also requires a certain way for customers to cancel if the customer signed up for the subscription online—I think a lot of our online clients are already doing that with their account settings online.”
More than 30 states and the District of Columbia regulate automatic-renewal billing. But as states potentially update their corporate obligations, companies may struggle to keep track of the growing patchwork of laws, Julie noted.
“I don’t necessarily see a conflict, but what we do see is a number of [requirements] that are not typical across the states. . . . [That] makes it a bit of a challenge to understand what the requirements are across the states and deciding if you’ll be in full compliance or be at risk in certain states,” she explained.
