SPP and MPS Halve Standards for Prosecuting Criminal Commercial Bribery and Corruption Cases
On April 6, 2022, the Supreme People’s Procuratorate (SPP) and the Ministry of Public Security (MPS) jointly issued the Provisions on the Standards for Filing and Prosecution of Criminal Cases Under the Jurisdiction of Public Security Organs (II), with effect from May 15, 2022.
In the June edition of GC Agenda China (subscription required), Morrison Foerster partner B. Chen Zhu shared his thoughts on the newly issued provisions that, “The monetary thresholds found in the new provisions represent new baselines for filing prosecutions. Other parts of the provisions dealing with other economic crimes set forth additional prosecution standards based on the impact, methodology, and background circumstances of the underlying crimes. Taken together, these changes reflect changes in China’s economic environment and stepped-up enforcement environment.“
