GoPro Patent Feud Puts US Limits on Some Insta360 Cameras

Lily Li spoke with Bloomberg Law regarding the U.S. International Trade Commission’s final determination in Investigation No. 337-TA-1400. The Commission found no violation as to all five asserted utility patents and affirmed that Insta360’s updated models fall outside the scope of GoPro’s asserted design patent. Lily emphasized that the limited exclusion order relating to the design patent “applies only to certain older models of Insta360’s Ace series and does not affect its current product lineup in the United States,” preserving Insta360’s continued right to import and sell its products without disruption.

This victory reflects a comprehensive litigation strategy encompassing non-infringement and invalidity defenses, expert testimony, sharp advocacy, and targeted briefing before the Commission.
