Andrew Turnbull spoke with HR Dive about the implications of the Administration’s executive orders targeting diversity, equity, and inclusion (DEI) programs. He emphasized the importance of conducting privileged DEI risk assessments, stating, “From there, employers can determine which programs, if any, present potential enforcement risks. They can also drill down to determine the degree of risk, whether low, medium or high, and ‘triage’ to determine how to move forward.” Andrew also noted that regulators are actively investigating DEI programs and that the absence of a DEI program does not preclude enforcement against employers found to have engaged in unlawful discrimination. He advised HR departments to recognize that the administration is scrutinizing both DEI initiatives and illegal discriminatory practices generally.
