Brian Sylvester spoke with Corporate Counsel about California’s proposed voluntary “non-ultraprocessed” food certification program and the uncertainty it could create for food companies. The legislation would establish a state-endorsed seal while adding to a growing patchwork of differing state, private and potentially federal definitions of ultraprocessed foods. Brian highlighted that given the uncertainty around how the program would be implemented, the potential for consumer confusion and the possibility that products would need to be reformulated, it remains unclear how many companies will make the choice to pursue certification, stating, “We’re not sure how consumers will respond to seeing these labels on food products.”
