11 Drafting Flaws for the European Commission to Address in its Upcoming GDPR Review

Morrison & Foerster senior of counsel Lokke Moerel authored an op-ed for IAPP’s Privacy Perspectives, “Eleven Drafting Flaws for the EC to Address in the Upcoming GDPR Review and Counting.”

In May 2020, the European Commission is set to deliver its first review report on the EU General Data Protection Regulation. Rumor has it that the commission does not intend to draft proposals to reform or fix apparent flaws in the GDPR. "The limited appetite for a substantial reform is understandable," she writes, "but I find it harder to justify the commission would not be willing to remedy apparent flaws. In this post for IAPP Privacy Perspectives, Lokke details 11 issues she has spotted in the regulation while welcoming other insights, as well.
