Lisa Phelan spoke to Global Competition Review about former Bumble Bee Foods CEO Christopher Lischewski, who was sentenced to 40 months in prison for conspiring to fix prices for canned tuna.
According to Lisa, the Department of Justice has likely achieved its goal of obtaining deterrence even though the final sentence was lower than it had hoped.
“They had to know it was a long shot,” Lisa said, describing the government as “unusually aggressive” in this case.
She also noted that the sentence was beyond the average 20-to-24 months delivered to defendants convicted of antitrust crimes.
“The judge definitely wanted to give over the norm,” Lisa said. “No judge wants to give the longest sentence ever.”
