James Koukios spoke to the Wall Street Journal for an article covering the latest edition of “A Resource Guide to the U.S. Foreign Corrupt Practices Act,” which incorporates nearly eight years of developments in anti-bribery law and clarifies the government’s view on controversial aspects of the statute’s enforcement.
While the Justice Department has taken an increasingly nuanced approach to corporate compliance in recent years in an effort to encourage companies to proactively stop bribery schemes before they happen, most of the hallmarks of an effective compliance program that were articulated in the 2012 edition of the FCPA guide remain intact.
“There’s a lot that’s still the same,” James said, who helped draft the original guide while serving as a senior prosecutor in the Justice Department’s FCPA unit.
