These 10 Decisions Remade the Trademark Landscape
Jennifer Lee Taylor spoke to Law360 for their article ranking the blockbuster decisions that shaped trademark law into what it is today.
“The Second Circuit decision [in Louboutin v. Yves St. Laurent] was important to brand owners because it affirmed the protectability of single color marks in the fashion industry in a case of first impression,” Jennifer said. “The lasting legacy is that we are seeing more companies asserting single color trademarks, in the fashion industry and elsewhere, and aggressively filing infringement actions based upon these claims.”
