In the September edition of GC Agenda China, (subscription required), Morrison & Foerster partner Paul McKenzie commented on the new measures issued by MOFCOM
"Implementing a more comprehensive mechanism for lodging foreign investment complaints is a key feature of the Foreign Investment Law. Issuance of the measures is therefore an important milestone. They are a significant improvement over the 2006 provisions they replace, broadening the scope of issues that can be considered and the classes of eligible complainant, and providing greater transparency and procedural certainty. The 2006 measures were seldom deployed by foreign investors. Maybe the new measures will be," said Paul.
