Texas Lawyer featured Joe Palmore in its recap of what lawyers live-tweeted during the Supreme Court argument in the Affordable Care Act case. “My sense is that there are likely at least 5 votes (3 liberals + Chief & Kavanaugh) for finding the ‘mandate’ severable from the rest of the ACA. The presumption in favor of severability will likely be too steep a hill for the challengers to climb,” Joe tweeted in closing. “I’m less sure on where the Court will come down on standing and the merits. But those are questions of largely academic interest here.
