Penelope Preovolos and Claudia Vetesi authored an article for Today’s General Counsel discussing basic advertising law, some risks consumer-facing brands should avoid, and some best practices. 

“Advertising laws cover both express and implied representations about products and services,” the authors wrote. “Deceptive advertising occurs when a statement or omission is likely to mislead a 'reasonable consumer' and the misrepresentation is important to the decision to purchase the product.”
